Who is exempt from licensing requirements

When is a license not required?
The licensing requirements do not apply to:
- A person who is licensed by the Texas State Board of Plumbing Examiners; a licensed engineer, registered architect, or registered landscape architect to the extent the person's acts are incidental to the pursuit of the person's profession.
- Irrigation or yard sprinkler work done by a residential property owner for a home he owns or occupies as his home.
- Irrigation or yard sprinkler repair work done by a maintenance person incidental to and on premises owned by the business in which the person is regularly employed. Repair work does not include extension of the existing system or installation of a replacement system. In addition, to remain exempt from licensing, the person performing the maintenance shall not engage in the occupation of licensed irrigator or in yard sprinkler construction or maintenance for the general public.
- Irrigation or yard sprinkler work done on the premises or equipment of a railroad by a regular employee of the railroad who does not engage in the occupation of licensed irrigator or in yard sprinkler construction or maintenance for the general public.
- Irrigation and yard sprinkler work done by a person who is regularly employed by a county, city, town, special district, or political subdivision of the state on public property.
- Irrigation or yard sprinkler work done by an agriculturist, agronomist, horticulturist, forester, gardener, contract gardener, garden or lawn caretaker, nurseryman, or grader or cultivator of land on land owned by the person.
- Irrigation or yard sprinkler work done by a member of a property owners' association as defined by Property Code, 202.001. The irrigation or yard sprinkler system shall be located on real property that is owned by the association or in common by the members of the association and used for aesthetic purposes or recreational purposes. The area of the irrigation or yard sprinkler system shall be less than one-half acre in size.
- A person who helps install, maintain, alter, repair, or service an irrigation system under the direct supervision of a licensed individual; or an owner of a business that employs a licensed irrigator to supervise the business's sale, design, consultation, installation, maintenance, alteration, repair, and service of irrigation systems.
- Even though you may be exempt from licensing, you must comply with the standards established by Title 30 TAC Chapter 344. Irrigation system does not include a system used on or by an agricultural operation as defined in Section 251.002, Agricultural Code.
